Duty-free lunch period for teachers

I have been asked by many, “Does HB 1151 mandate a duty-free lunch period for teachers?”

The answer is “YES”. The law states that School Improvement Plans "shall" include a plan to provide a duty-free lunch period for every teacher, either on a daily basis or as otherwise approved by the school improvement team. "Shall" means shall. The phrase "or as otherwise approved by the school improvement team," refers solely to how often the duty-free lunch must take place, with "on a daily basis" as the default. This phrase "or as otherwise approved by the school improvement team," does not affect whether or not the plan must provide a duty-free lunch period - the legislature has decided that this "shall" occur.
